The Justice Department Unveils Proposed Section 230 Legislation on Behalf of the Administration

Today, on behalf of the Trump Administration, the Department of Justice sent draft legislation to Congress to reform Section 230 of the Communications Decency Act.  The draft legislative text implements reforms that the Department of Justice deemed necessary in its June Recommendations and follows a yearlong review of the outdated statute.  The legislation also executes President Trump’s directive from the Executive Order on Preventing Online Censorship.  

“For too long Section 230 has provided a shield for online platforms to operate with impunity,” said Attorney General William P. Barr.  “Ensuring that the internet is a safe, but also vibrant, open and competitive environment is vitally important to America.  We therefore urge Congress to make these necessary reforms to Section 230 and begin to hold online platforms accountable both when they unlawfully censor speech and when they knowingly facilitate criminal activity online.”

“The Department’s proposal is an important step in reforming Section 230 to further its original goal: providing liability protection to encourage good behavior online,” said Deputy Attorney General Jeffrey A. Rosen.  “The proposal makes clear that, when interactive computer services willfully distribute illegal material or moderate content in bad faith, Section 230 should not shield them from the consequences of their actions.”

The Department of Justice is grateful to all the experts, victims’ groups, academics, businesses, and other stakeholders that have and continue to engage closely with the department during this process.  The draft legislation reflects important and helpful feedback received thus far.  The department is also grateful to our colleagues in Congress for their support on Section 230 reform and looks forward to continued engagement moving forward.

        1. Giving some thought to your “anything special in Delaware law” … all that I know about Delaware is so many incorporations are done in Delaware, has been the case since I first worked in a law office back in the Dark Ages.

          The Delaware corporation statute can’t by itself account for Delaware’s success in attracting corporate incorporations. The other major reason corporations choose to incorporate in Delaware is the quality of Delaware courts and judges. Delaware has a special court, the Court of Chancery, to rule on corporate law disputes without juries.

      1. Looks like serious problems with him. Dan Bongino keeps saying his inside sources say it’s a very rapid decline. However, with the first debate days away I’m sure extraordinary efforts are being made…medical and debate prep…are in full gear.

    1. This won’t fly (no pun intended) with a lot of us. I love Kristi Noem — but killing an animal just because you get a charge out of shooting is something I will never understand. More than a sufficient amount of animals have already given the gift so that we might eat. I have relatives in East Texas that are overrun with boar — that’s a reason to hunt. And please don’t start with the culling the herd nonsense. No one is going out there looking for the old sickly one to hang on the wall.

      I just can’t stand this.

      1. Where’d you get that idea?? All the bird hunters I know generally have dogs that retrieve. People eat the birds for food. Ducks, dove, cornish hens, pheasant, grouse (prairie chicken), etc… Responsible hunters eat what they kill. Governor Noem is pretty responsible, to assume she’s killing for the heck of it in this short video is a stretch. It is the start of bird hunting season after all.

            1. We have a Neighbor/ close friend that goes to South Dakota every fall to bird hunt and often have Thanksgiving dinner at their home…appetizers are often those grilled doves!
              Reminds me, I used to order a box of “dressed” quail to prepare at home and I had forgotten about that….will have to do that again soon.

              1. We got some SERIOUS Texas boys, always something in season and they take full advantage of it. Have their licenses and getting their gear ready, months in advance. Off season, back to FISHING, boats, trucks, and sports of every kind. One nephew just spent over $12k on a pedigreed ‘hunting’ puppy. No telling how much training costs! $20K dog before it’s all said and done??🙄

          1. There was nothing in that clip to indicate ANYTHING about where the pheasant would ultimately wind up, one way or another. And the very same point could have been made – the same mood set – at a range, or where you shoot something flying through the air out of a machine. The whole thing was very cavalier. As I said in another comment, there’s a reason you no longer see Eric or Don Jr. standing over dead animals that they’ve shot. If you need the meat, go get it. If you’re just baiting deer and drinking beer, it’s a different story.


        2. My father was a hunter and was very responsible. He never hunted more than for a big Sunday meal. His friends were the same. He loved animals and we often walked the woods specially in winder after it snowed to watch animals tracking where they walked.
          I see often more abuse toward animals from people in suburbs with their dogs and cats and tying up their dogs in chains no dog house summer and winter.
          I do not hunt but when I can get venison I am happy to prepare.
          Do understand people who do not like hunting and they have all my respect. I also understand hunters who are responsible. Here in Appalachia many people would starve is they were not hunting getting meat they hunt. They are proud people would never take handouts.

        3. It’s a photo shoot. And there’s a camper in her line of fire, on the right. Grouse only starts 9/19. I just find mowing down an animal for a photo shoot off-putting – as in how many takes were there. And I’m no crazed vegan, but do you notice you never see POTUS’ sons with dead animals in sport hunting photos anymore? Someone got the memo.

        4. Last point and I’m done. Would you be so forgiving if she chose to kill a deer for a TV shoot? And you see it go down, then she finished the shoot talking while holding it’s head off the ground. Birds don’t generate the same feelings. They die instantly, they don’t wander around for days with an arrow through their neck from some fool that doesn’t know what he’s doing. There’s a reason all those outdoor shows go from the shot to the animal dead on the ground — they don’t show you what happens in-between.


      2. As I understand it, that’s how pheasant hunting is done. I guarantee you a retriever was sent to get the bird.

        I don’t care to hunt and fish, but I have a lot of relatives who do. Here in STL county, the COUNTY has a program in the fall to thin the herd of deer. THOUSANDS of head are culled and a local butcher processes the meat which is then sent to the food banks to be distributed to the poor. Otherwise, the damage to private property would be in the billions every winter.

        People who really are serious about hunting and fishing don’t kill just to kill. When some relatives had a clubhouse on a lake and fishing was an all weekend affair, only certain sizes were kept. The rest were thrown back. I’ve known hunters who pass on does with a fawn. That’s just part of smart conservation.

        1. If someone needs that venison as a supplement for the family, by all means go get it. But to put out sweet feed for bait, and just mow down an animal for the hell of it is just cringeworthy.

          My husband has an uncle who is consumed by hunting. He eats NOTHING. He hunts to put trophies on a wall. I have no idea whether he donates the meat. But his next big thing is bear – and I’ve never heard of that being eaten apart from in the movies.

          People who get a charge out of shooting something, where that’s the sole purpose – have a screw loose. And as I said before, none of them are going out in search of the old sickly one that’s unlikely to make it through the winter.

          Fishing is a different story. If it isn’t thrown back it’s corn meal and a frying pan.

        1. I became a vegetarian for 15 years after watching a TV documentary how large chicken processing plants kill chicken and process them. This experience was disgusting worse thing I ever have seen. Worse than hunting. The inhumanity is incredible in slaughter houses.
          I now only buy meats that are humanly raised and slaughtered. I only buy chicken that are allowed to graze and live a life that is kind.

          1. Well, I suppose “cage free” eggs is a really good thing also. Yea, that was sarcasm at its worst, I suppose. Personally, I decry the idiotic “cage free” CA imposes…increasing costs. Dumb. IMO.

            Have no problem with hunting, fishing…so long as the food does not go to waste.

            Nor do I fret over slaughter houses, meat packing plants…or whatever one may call them.

            As a kid I saw, at the local fish and poultry shop, back up a truckload of chickens. Chickens got hung up by their feet. Guess their heads lopped off “out of sight”. friends and I went in and bout a couple pounds of wings to BBQ.

            Have seen chickens, pigs and other animals killed in the Philippines on one side of the yard and cooked on the other side.. By US standards, some would say crude. Not me. IMO, quite normal. No different than, “the Old West”.

            Nothing bad about Noem hunting. Would bet that video was an after thought while out in the field.

            1. Kristi is pretty active, and her muscles are well toned. She barrel races. Being an avid hunter does not surprise me. She takes advantage of all SD has to offer. Plus she’s Patriotic and Smart as a whip!! Can you tell I have a girl crush? It happened at the 4th of July Mt. Rushmore celebration! 🎆🎆🎆😊 Give her some years and some Foreign Policy experience, she’s going places!

            2. My grandmother had chickens but she was kind to them. I have seen her kill them even pigs but it was different. Used to go fishing as kid and was shown how to kill them after they are caught so they do not suffer.

      3. As a Texas outdoorsman who shot his first deer at age 8 and has hunted/fished all over America for over 5 decades, I know just how you feel. The rule is as simple as it is ironclad…you don’t kill what you don’t intend to eat. PERIOD. Full stop.

        But I also can’t stand it when people accuse others with no evidence whatsoever to support their accusations, like you did. Even worse is when the accusation comes from someone who quite clearly has no idea what they are talking about, which you clearly don’t.

        It’s just like shooting something for no reason. Pure, unfiltered, 100% ignorance.

        This was clearly a professionally guided PHEASANT hunt (a bird considered a true DELICACY) and there were at LEAST 5 sets of eyeballs that marked that downed bird (the gov., her guide, the cameraman, and at least 2 other shooters). No way was that rooster shot and left to lay.

        No. Way.

        That’s also against the laws. So you are, effectively, accusing Kristi Noem of being an idiot who would tweet out a video of herself breaking the law….which itself is laughably dumb.

        What do you think the effective range of a shotgun is in this specific hunting situation? Lemme tell you. For a bird, about 50 yards…IF….you are A) absolutely spot on in aim, B) shooting a 12 gauge, C) shooting a 3 inch shell (or better), D) using a full choke, and E) throwing #4 lead….none of which you understand or know anything about, as evidence by your comment.

        And not only that, her line of fire was clearly ABOVE the object in question. At best it got “peppered” from any shotgun pellets (meaning said pellets fell harmlessly upon it).

          I don’t hunt. I think there’s more than enough food available, provided you have the means buy it. If you don’t and you need/want to supplement for yourself or your family, by all means hunt. But don’t insult me by acting like no one just goes out and shoots for the hell of it.

            I am not a hunter, and the one time a fish was hooked on a rod I was holding I screamed for my beloved cousin to GET IT OFF OF THERE! I must agree that the way the objection to the original post was worded was that of someone assuming the worst.


            1. I didn’t post the video. I commented on it. I prefaced the whole thing with “I love Kristi Noem” . . . and the whole POINT of the video was to convey a matter of fact, this is how we roll demeanor. It was too cavalier for my taste. Not drunken college kid, reckless cavalier, just matter of fact. I have stated and re-stated everything I intend to say on this, ad nauseum.

              As I said in one of those comments, if she chose to shoot a deer, and gave the sign-off on her knees holding the animal’s head off the ground — would it still be all good? But what do I know — I’m just an emotional cripple. I’m for sure had my fill of that technique being used here.

    The Anti Defamation League is an organization which vows to “Fight anti-Semitism and all forms of hate” and specialize in Hate Crimes, Cyberhatred and extremism. The ADL have the most famous database of hate symbols which is used by many different police and security departments as a guideline as to what is acceptable to use.

    The database contains things that are quite obviously hate symbols such as the Swastika, Iron Cross, KKK logo etc but also some lesser known ones such as Nordic runes and various abbreviations. The symbols are almost all Far right based which isn’t itself a problem and I do agree that far right groups are very dangerous however I want to bring attention to the other side of political views with the rise of Far LEFT extreme groups which have notoriously committed countless beatings, assaults, muggings and vandalized and looted several stores during rallies and protests for example the G20 Summit in Germany saw thousands of ANTIFA members burning cars, breaking windows and looting jewellery stores wearing black masks to hide identity.

    The biggest and most famous group that commits these crimes is ANTIFA which is a far left organization which started out as opposition to far right wingers but has been completely taken over by Communists.

    My goal and the goal of this petition is to hopefully bring attention to these extreme groups and that the ADL will realize the dangers of far left ideologies (Communism in particular). While Communism isn’t anti Semitic It teaches hatred against anyone that isn’t communist and seek to silence opposition.

    Historically Communism has killed many more people that Nazism did yet people nowadays can freely walk around with a USSR flag and say they are a communist! I believe that it is time to stop that and bring attention to these violent and hateful Far left groups!

      Rush posited on his radio show today that Ole Joe’s handlers are putting him through a rigorous physical and mental regime to get him ready for the debate on September 29.
      Rush ALSO talked about SUNDOWNERS SYNDROME and Biden.
      Think about that.
      If this is true — and, given Biden’s observed physical and mental deficits, it is possible — they’re likely:
      Keeping him up past 10PM to counteract Sundowners Syndrome;
      Coming up with a “drug cocktail” to keep him awake and/or coherent and/or able to process;
      Making him memorize any number of repostes, answers, slogans, etc., for use during the debate;

      On the other hand, if Biden gives his handlers signals that he can’t make it through, they’ll come up with a “person that the former Vice President had close contact with who tested positive for COVID-19” to announce that Biden has “to go into quarantine for his health” — so, Sayonara to the debate.

    Here’s how it works. The vaccine companies are looking for a total of 150 (mild) COVID cases to occur, combined, in the two groups; those receiving the placebo and those receiving the vaccine. How would that happen? The researchers believe ‘the coronavirus is spreading everywhere and it will pounce on some of the volunteers in the clinical trial.’

    Let’s say that, during the trial, 100 people receiving the placebo develop mild COVID-19, and only 50 people receiving the vaccine develop mild COVID.

    The vaccine companies would say, ‘We just proved the vaccine is 50% effective in preventing COVID, and that’s all we need to do, in order to win authorization from the FDA. Release the vaccine. Inject the world.’

    The irrelevant outcomes for 150 people equal ‘let’s shoot up seven billion people.’ That’s staggering.

    But it gets even worse. The magic number of 150 COVID cases? How is a COVID case defined? The authors of the Times piece have the answer:

    “In the Moderna and Pfizer trials, even a mild case of Covid-19 – for instance, a cough plus a positive lab test – would qualify and muddy the results. AstraZeneca is slightly more stringent but would still count mild symptoms like a cough plus fever as a case.”

      2. I might be wrong, but my understanding was the monies were sent to private banks to make the loans under the set guidelines given by the government which would mean the banks vetted the loans.
