The Justice Department Unveils Proposed Section 230 Legislation on Behalf of the Administration

Today, on behalf of the Trump Administration, the Department of Justice sent draft legislation to Congress to reform Section 230 of the Communications Decency Act.  The draft legislative text implements reforms that the Department of Justice deemed necessary in its June Recommendations and follows a yearlong review of the outdated statute.  The legislation also executes President Trump’s directive from the Executive Order on Preventing Online Censorship.  

“For too long Section 230 has provided a shield for online platforms to operate with impunity,” said Attorney General William P. Barr.  “Ensuring that the internet is a safe, but also vibrant, open and competitive environment is vitally important to America.  We therefore urge Congress to make these necessary reforms to Section 230 and begin to hold online platforms accountable both when they unlawfully censor speech and when they knowingly facilitate criminal activity online.”

“The Department’s proposal is an important step in reforming Section 230 to further its original goal: providing liability protection to encourage good behavior online,” said Deputy Attorney General Jeffrey A. Rosen.  “The proposal makes clear that, when interactive computer services willfully distribute illegal material or moderate content in bad faith, Section 230 should not shield them from the consequences of their actions.”

The Department of Justice is grateful to all the experts, victims’ groups, academics, businesses, and other stakeholders that have and continue to engage closely with the department during this process.  The draft legislation reflects important and helpful feedback received thus far.  The department is also grateful to our colleagues in Congress for their support on Section 230 reform and looks forward to continued engagement moving forward.

            Yeah, it’s males in their species they get downright aggressive towards, just automatically. It’s a “territory” thing.

            Now if I were to act like a predator, he might get feisty, but I don’t.

            A bearded dragon in the wild once managed to bite Steve Irwin on the nose. He was face to face with it, it felt threatened, puffed up its beard and turned it black and opened its mouth. Irwin was was lying on the ground, face to face with it, saying “Oooh, you’d better back off or I’m going to bite you” (describing what the lizard was “saying”) and the lizard jumped and bit him.

    1. I read that the way that the Komodo dragon kills it’s prey, is that they bite them, then fall back for awhile.

      Their bite is toxic because there is so much bacteria in their saliva, and the prey gets sick and falls down.
      Then they go in for the kill.

      That’s sort of a good metaphor for the way that the Left operates…

      The Left has their media nozzles launch lies and false narratives about anyone who opposes them.
      Once their poison has damaged their target…then they try to go in for the kill.

      This hasn’t worked on our fearless VSG President.
      That’s why the Left is in such a panic.

      1. The way I understand it is that they tend not to fight prey. They’ll get in close by stealth and clomp on something, messing up the prey’s mobility. Then when the prey flees, they’ll pursue it in “terminator mode” at a walk while the venom/infection ravages the victim. When the prey is immobile, they’ll feed.

        It should be noted that the Gila Monster and its much prettier cousin, the Mexican Beaded Lizard, chomp into prey and gnaw a bit while actual venom flows into the wounds through grooves in their teeth. This is far more primitive than the syringe-like fangs of rattlesnakes and cobras. It is a matter of some debate whether Komodo dragons also produce an actual toxin beyond the septic bacterial conditions in their mouths.

      2. You’re part right, but I’ll bet your memory is solid. New info has come to light.

        Their bite contains amazingly little in the way of bacteria; their oral hygiene is pretty good for critters who don’t have toothbrushes. But it turns out that they actually DO have venom and so all those old sources that claim they didn’t…were wrong.

        The reason they have a reputation for an infectious bite is that water buffalos that get nipped immediately go to their wallows to soothe the pain…and the wallows are full of water buffalo poo.

        And yes, often if the prey is bigger than they are they will wait until it weakens. Smaller prey (like Timor deer) they kill outright.

        Komodos succeed in their attempts to kill prey about 90 percent of the time, far more than lions do.

            1. A “pixellated” 100-square-mile island is 10×10. A Komodo willing to pursue for 4 miles is in a substantially better strategic position than a lion in a limitless veldt.

                Besides, they’re mostly “ambush” type predators, turning on animals that up til now have considered them mere nuisances.


      1. Meant to say…zap a lot of traitors.
        While not Komodo, when I was a child my father happened across a couple of very young fox that had apparently been abandoned by the mother…a male and female. He brought them home, built a large cage enclosure outside with the idea my brother and I would care for them until they were big enough to release. Everything went along splendidly for a few months until one morning we went out to take care of them and found that the male had killed and half-eaten the female. Needless to say, a bit of a shock to us.
        We ended up calling the major zoo in our state to see if they were interested in accepting the male and that’s where he ended up spending the rest of his days.
        I remember at the time, we were told that the female was probably sickly and that is common among wild animals…have no idea if that was true or not but I think it was to make us feel better about the incident.


  3. Ecclesiastes is my favorite book in the Bible, but I have to confess that the translation being used in the post doesn’t have the same “zing” as the KJV. As a kid, I went through the KJV against the New English Bible (which was based on some hard-core scholarship) in several sections….and, though the plain meaning of the NEB could be affirmatively traced to original texts, it told my younger self that a touch of Divine inspiration was involved in the KJV (except, of course, in the numerous clearly erroneous passages). The KJV reads like poetry, from and to the heart.

    Vanity of vanities, saith the Preacher, vanity of vanities; all is vanity. What profit hath a man of all his labour which he taketh under the sun? One generation passeth away, and another generation cometh: but the earth abideth for ever. The sun also ariseth, and the sun goeth down, and hasteth to his place where he arose. The wind goeth toward the south, and turneth about unto the north; it whirleth about continually, and the wind returneth again according to his circuits. All the rivers run into the sea; yet the sea is not full; unto the place from whence the rivers come, thither they return again.     1. I’m going to drill down on a couple of things. First, because it took me forever to do, I’m going to note that certain words are emphasized in the KJV — textually by being presented in italics. One of the more common words to be so emphasized is “is”…..but not all uses of that word get the emphasis. Other words also get the same treatment.

      These words change the rhythm of the passage and very subtly influence its meaning. Sheer poetry.

      Second, I’d like to highlight the word choice in one verse. KJV: “All the rivers run into the sea; yet the sea is not full; unto the place from whence the rivers come, thither they return again.” Quoted in the post: “All streams run to the sea, but the sea is not full; to the place where the streams flow, there they flow again.” I would say that the latter translation was somewhat poisoned by hydrology.

      In the world of natural observation, springs appear from the earth bearing water. This leads to streams and rivulets, which combine into mighty rivers draining vast areas. In hydrology, rain on mountains flows downhill and permeates loose soils. A certain amount of this is trapped under a layer of clay and later, downhill, breaks out in a spring. All water flows are “streams” and there are atmospheric streams where water vapor from the oceans leads to rain in the mountains.

      It is unlikely that Solomon viewed streams as a modern hydrologist would — to him, it is as much a wonder that oceans never fill as that mountain springs provide water. The more recent translation merely illustrates textbook water flow.

      And, yet…..isn’t one of God’s greatest Creations a world where He doesn’t have to do outright miracles constantly to keep it running?

      1. I was once told the italics in the Old Testament were for words that weren’t in the original Hebrew. Semitic languages get by without any exact equivalent for the verb “to be”, for example.

The italics denote words that the translators had to insert because a literal translation would have been choppy to our ears without them, like hearing a Russian drop “a,” “an,” and “the” because those words don’t exist in Russian (if you think about it they’re not really necessary). [A Russian has a hard time learning when “the” is appropriate vs. “a/an”, and sometimes when you get a piece of spam mail from a content farm in Russia, that’s the one thing they didn’t get right.] You know what they mean, but it’s not good English. Similarly with the forms of “to be” in English that appear in the Bible. They weren’t there in the original, but the English won’t read smoothly without them.

        It has little to do with restoring meter, though of course, often times the meter would be gone without them, but that’s because the translators made sure the final result would have meter and would have done so even if they were directed to leave those words out.

    2. In the KJV the italics were added to show that the words were not in the original manuscripts but were added to make the meaning more clear. It’s sometimes interesting to try to read the KJV leaving out the italicized words.

Hebrew and Greek are very different languages, and if one were to do a word-for-word gloss (i.e., simply writing the translation for a word directly above it), one would see the word order and phrase construction be totally different, and you’d be struck at just how different it is putting sentences together in those languages. You’d probably initially wonder how on earth they can remember to do it that way and breathe at the same time–but to them it’s normal, and English would look cockeyed.

        1. You’re right, Steve. If people want to get an idea of what Greek and Hebrew word-for-word would be like, you can take a look at Young’s Literal translation, which is based on the textus receptus. The KJV is a much more literal translation than, say, the NIV.

        2. My Father learned Hebrew, Greek and Latin so he could read the more original texts of the Bible when he was in school. It was always fun to watch the Mormons try to argue the Bible with him since I think he had the whole book memorized.

    3. Here’s the thing, being Catholic, I can’t use the King James. There are errors, a lot of them, and things added and the seven Helenistic Canon books missing.

      You want to read the two TRULY beautiful books? Ecclesiasticus (Sirach and Wisdom ( Those are my faves.

      It’s very sad that so many followers of Christ don’t know those books along with Baruch, Tobias (Tobit), Judith and the Maccabbees because Martin Luther decided to switch out the original Old Testament – the one that Christ would have known – the Septuagint with the Masoretic Text of the post-Christ Jerusalem Jews.

      And what any one person thinks about this particular subject is usually determined by the source material they are willing to believe.

    • Section 230 doesn’t stop the states, whether they work alone or together or with DOJ, from using their own state laws against platforms that are engaged in defrauding or misleading users.
    • Section 230 does not bar the states from bringing state law causes of action based on the platform’s own conduct, as opposed to its role hosting third-party conduct, and when they engage in unfair and deceptive practices, state AGs can be the tip of the spear.
    • DOJ also will provide the ability for individuals to pursue civil claims against online platforms that engage in bad-faith censorship.

  7. It’s almost mind numbing anymore, one city is like the next. BUT in Portland I don’t understand why the police continue the game. They can’t deploy much in the way of non lethals so why bother? What are they trying to protect? Wheeler has them go out there for antifa’s entertainment?

    Anyway, my friend and I were talking about the fires they start and the molotov cocktails..what are they using ? It seems way more than gasoline. Some of those small fires last so long, unusually long

    1. That means people will continue to stay home, a lot, because that’s one of the few places where they can go mask free.

      Restaurants will be screwed.
      As will a lot of retail stores…since mask-wearing tends to shorten leisurely shopping.
      You want to get it over with quickly so you can go back home and tear that mask off.

  11. PA Supreme Court decision, which seems basic to me, infuriates the left. they believe at least 100,000 people aren’t smart enough to follow the instructions.
    The Pennsylvania Supreme Court has ordered local election officials to toss out “naked ballots” and Democrats are livid.

    For an absentee ballot to be counted, it not only must be received on time, but it has to be placed in an inner envelope with several anti-fraud protections. The Supreme Court ruled the naked ballots were not valid and should be tossed.

    But Democrats are screaming about “disenfranchised voters” because they failed to follow the simple directions in mailing their ballots. It’s not rocket science. You mark and sign your ballot, you put it in the security envelope, and then mail it. It defies logic and understanding why any voter can’t follow those simple instructions.

    In a letter sent to Republican leaders in the state legislature on Monday, Lisa Deeley, the chair of the Philadelphia city commissioners, warned that the court ruling could result in more than 100,000 mail ballots being thrown out and urged lawmakers to swiftly eliminate the secrecy envelope requirement for mail ballots.

      1. I.Q. has very little relationship to wisdom, character or even level of education. Knew a fellow born in 1906 with a high school education that was so successful at learning on his own that he got one of the top I.Q. scores in a major University study at the time.

        BUT I think that just made him a target for influence and his focus was on how smart he was. No grasp of foundations of our nation, no grasp of moral basis for protecting the weak, the innocent, the unborn. In full agreement with removing “undesirables” from society. He was influenced to become an influencer.

People who know nothing making decisions which negatively impact an entire society of other people. The media manipulates them in ways that weren’t possible 200 years ago.   14. interesting premise: the Senate has a planned “recess” from Columbus Day to November 6th. The President could and should make a recess appointment to SCOTUS.
    This year, the Senate has a 25-day recess pre-planned from October 12 (Columbus Day) through November 6. The Senate calls these days off “state work periods,” the Senate’s fancy description for a “recess.” Put another way, they schedule that time (Oct. 12–Nov. 6) so they can go home, politic, and campaign, as some face re-election.

    If a new Supreme Court justice is not confirmed by October 12, then President Trump should follow precedent set by two other Republican presidents, Lincoln and Eisenhower, and make it a great Columbus Day with a recess appointment to the Supreme Court.

    The recess appointment would be valid through the end of the congressional term, in this case January 3, 2021. The Senate could and should permanently confirm the nominee before then.

    The president would be within his constitutional authority to make the recess appointment, on October 12, assuming that the seat isn’t yet filled and assuming the Senate does in fact recess on that day, for the final push of the election season.

      But first, recess appointment is less than a second place finish, IMO. Temporary appointments. Better than nothing, but, unacceptable given we can easily have confirmation. Recess appointment would be wholly unacceptable to President Trump, and Americans.
      IF the plan is really for the Senate to recess 12 October, then it becomes obvious our upcoming SC nominee will not have Senate Judiciary Committee hearings. Nomination, Saturday the 26th. Straight to meet and greet, Followed by confirmation.
      – D-Rats will be splody head over no Senate Judiciary Hearings to grand stand for national spotlight. We win again.
      – Worth noting, October 12th is a Monday. Are, our lazy Senators really planning to be in Washington the 10th and 11th, Saturday and Sunday. No, me thinks.
      – Weekends and holidays are favorable, in this situation, IMO.
      The possibility of confirming a Justice in record fifteen days is likely, too good to be true. But, possible. Certainly would be an excellent lesson for D-Rats to never, ever mistreat a SC nominee gain, as they treated Kavanaugh.
      Regardless, Rs will have to growacet, as D-Rats will create faux crisis accusations against whoever the SC nominee is, in an effort to sway four Rs to block confirmation. D-Rats will try. But, Rs will hold enough of the line to confirm.

        i think Mitch has avoided a recess by leaving someone there? in the past so not sure this would fly anyway…i think the author is just throwing out options–and options that have been used before.

        and it would forestall the circus a nomination and hearings will bring.

      by Stefania Vitali , James B. Glattfelder, and Stefano Battiston, shows the strings attached from the financial sector to the corporations. And by now, thanks to Trump everyone should be aware of the money strings on our politicians. One point the paper does not mentioned is mutual funds, trusts and pension plans.

      If you invest in a mutual fund you are buying shares in the mutual fund (that you can not vote) and the Mutual Fund then uses YOUR money to buy stock shares which it owns and controls. This allows much more consolidation of control. For example Edward C Johnson 3rd, chairman of the Fidelity Group votes the stock in Monsanto owned by several pension and mutual funds like FMR LLC, FIDELITY MAGELLAN FUND INC, FIDELITY GROWTH COMPANY FUND, and Pyramis Global Advisors. The vanguard Group, aka John C. Bogle, owns another healthy chunk of Monsanto. In this way even more power is concentrated in the hands of a few. This explains the point made in the paper that the amount of power is greater than the amount of wealth can account for.

      So facts like “85% of Monsanto is held by mutual funds and Institutional (financial) Holders” while true in that the money originated from pensioners and other little people does not tell the whole story. Yet it is trumpeted by those who want to confuse those trying to follow the money and power trails and misdirect us into thinking the stock is held and voted by pensioners – a complete and utter falsehood.

      The 2013 article Financial Core of the Transnational Corporate Class lists the top companies AND the officers running these corporations.

    A) It’s possible the Senate could consider a stopgap spending bill today to avoid a shutdown. After a dispute with Republicans and farm state lawmakers, Pelosi went back to negotiations with Steve Mnuchin on a Band-Aid bill to avert a shutdown.

    B) Republicans howled about the lack of money for the Commodity Credit Corporation, on which farmers rely. A revamped bill passed the House in overwhelming fashion Tuesday night. But it’s not clear when the Senate will tackle the plan.

    C) However, Fox is told that once the Senate takes up the bill, it’s doubtful the Senate will have to bounce it back to the House. The Senate would essentially accept the House’s version.

    That said, they are running out of time.

    D) The House and Senate will not be in session on Monday due to Yom Kippur. The Senate is not in session tomorrow. That leaves only Tuesday and Wednesday next week – especially if there’s a problem (which we are not expecting at this point).

    E) The government is funded through 11:59:59 pm et on September 30 (next Wednesday). The interim bill would fund the government through December 11. Keep in mind that most Republicans preferred a shorter time-span.

    F) If President Trump loses and the GOP loses control of the Senate, Republicans can still influence policy in the next round of spending. That would not be as likely if the interim bill ran until early next year – an end date preferred by Democrats

  17. Looking into my crystal ball here… I see a shorter and better remedy …

    1) POTUS announces his nominee for SCOTUS at 5:00 pm on Saturday at his scheduled Rally.

    2) On Tuesday (Senate will observe Yom Kippur on Monday) the Senate will pass the House interim bill which will fund the government through December 11 (present funding ends September 30). Or, they drag their discussion out until Wednesday, when they do pass it.

    3) Having taken care to see that the government will be funded beyond election day, Nov. 3rd, the Republican senators will now bring POTUS’ nominee for SCOTUS to the floor for confirmation. THERE WILL BE NO HEARINGS.

    4) I predict that POTUS’ nominee will be confirmed and installed in time for the next term of Court, which is Monday, October 5th.

    There is NO Constitutional requirement for hearings… which have only been ‘tradition’ since 1916 when President Woodrow Wilson picked his aide Louis Brandeis for a spot on the court. (Brandeis was the first Jew to be nominated). Even then the nominee did not appear at the hearings. There have been at least a dozen confirmed without hearings since then.

    VPOTUS Mike Pence has called for (first I think on Lou Dobbs program) this present vacancy to be filled with NO hearing. I think it will be done, regardless of the moanin’ and groanin’ by the commie left…

    2. Here’s what I see happening, should we put someone on SCOTUS with no hearings.

      The dems will create some false charge like they did with Kavanaugh, and all we will hear between now and November 3 from them is how we should have held a hearing because then we could have avoided confirming So-and-so who has such-and-such stain on their record. Since we won’t have hashed it out in hearings (and made the dems look bad when it became evident it was bullshit) there simply won’t be a “lose” for them on that one.

        Bottom line: If we DON’T confirm the nominee BEFORE the election, we can kiss our Republic goodbye as we will have chaos worse than 2000 w/ hanging chads, etc… and we will have a split Court 4-4 unable to make a decision. Frankly I don’t care what the commies SAY… I care about saving our country. Additionally, if there were time (in an alternate universe) I would not give them Hearings wherein they would attempt to destroy our nominee, and this time a female… all on POTUS’ list were vetted recently when POTUS appointed them to a bench… they are all judges NOW… no need to replicate a vetting simply to give them an opportunity to destroy a human being. Nanzi is already suggesting the nominee can be rejected because of their faith. Nope, DIMS don’t play by any rules… the less we PLAY with them, the greater the chance they win, and the prize is our country.

    1. America is over medicated because of big pharma pushing their poison.
      Sure some people need meds but to often dr prescribe unnecessary meds and people often expect to walk out of the doctor office being given meds. That is one of my pet beefs seeing pharma reps in the doctor office. To me they are not better than drug pushers.
      CDC FDA and Pharma all should have to answer for their crimes. Many people believe that HCQ does not work. I wish POTUS could fight this.
      You people have no idea how often doctors wanted to push drugs on me without my asking from sleeping pills to happy pills to blood pressure pills. I never ask and have no problem sleeping. I am not depressed never have been. I do have heightened blood pressure going to the doctor. Now that he accepted my blood pressure as situational to doctor my blood pressure is normal seeing him. I have no high blood pressure.
